    Understanding your legal rights and the defense strategies available to you is crucial when facing criminal charges. Knowing what the law protects you from, whatever the allegation—be it a misdemeanor or a serious felony—can make all the world of difference in the eventual outcome of your case.

    Most Commonly Known Rights: The Right To Remain Silent

    Every individual in the United States is expected to have specific constitutional rights in the event he or she is accused of a crime. Among the most commonly known of such rights are the right to remain silent, the right to legal counsel, the right to a fair trial, and the right to due process. Exercising these rights ensures that you do not make statements that could inadvertently incriminate you and that you are treated with fairness in the opportunity you are given to defend yourself against any allegations.     Defense Arguments Differ Depending on the Type of Charges

    Another essential strategy is the identification of breaches of constitutional rights. If the police do not read a Miranda warning or engage in unlawful questioning, this evidence becomes opt out of admissibility in court. This could render a serious blow to the prosecution’s case.
